The Employee Handbook: A Tool to Prevent Employment Litigation

When The Equal Employment Opportunity Commission investigates charges of discrimination, their “primary focus,” according to attorney Diane E. Stanton, “is whether the employer charged with discrimination can show the employee alleging discrimination was treated the same as similarly situated employees.”  In other words, could your company document, through written records and policies, that the employee was treated exactly like any other employee would have been in the same situation?

Ms. Stanton continues: “If a company can provide the investigating agency with a copy of the handbook, a copy of the employee’s signed receipt for the handbook, and the documentation that shows the employee was treated in accordance with the policy, i.e. consistently, the charge of discrimination is usually dismissed.”

Be aware that some states consider an employee handbook as a “contract” of sorts, and the handbook might need to include an appropriate “disclaimer” which will indicate to the employee that it is not intended as a contract and is for informal purposes only.
