One of the advantages of enrollment with a PEO is the fact that your PEO’s Human Resource Department can help you decipher some of the legal technicalities that exist as a result of Federal Legislation regarding discrimination.
Title VII of the Civil Rights ActTitle VII prohibits discrimination in employment based on race, color, sex, religion, or national origin. This is a broadly applied law and can encompass everything from hiring and termination of employees, to compensation. Your company’s best defense against a discrimination lawsuit is to investigate any reports of discrimination promptly and confidentially. We act as a valuable “neutral” third party.
The Age Discrimination in Employment ActUnless age is truly an occupational qualification, this Act prevents an employer from discriminating against applicants or employees over the age of 40. With the exception of some limited circumstances, the act also prevents a company from imposing a mandatory retirement age. Use caution when refusing to hire any individual over the age of 40 in the event that your refusal to hire might be construed as discrimination.
The Americans With Disabilities ActThis Act prohibits an employer from discriminating against a “qualified individual with a disability.” It mandates that if a prospective employee is capable of performing the “essential functions” of a job, then the employer must consider him for employment, and must also provide “reasonable accommodation” such as wheelchair ramps, larger computer screens, or even a modified work schedule. (The employer is not required to provide reasonable accommodation if doing poses an undue hardship to the employer).
